Chapter 7 bankruptcy can be a great option for people who have any amount of unsecured debt which they are unable to pay, such as credit card debt, medical bills or any other debt that is not backed by collateral. There are certain criteria that need to be met in order to qualify for a Chapter 7 filing. The most significant is the means test, which determines whether, based upon your income, you are eligible to file a Chapter 7. If you have a high enough level of disposable income, you may be required to file under Chapter 13. One important exception to the means test requirement is for business owners. If more than 50 percent of your debt are non-consumer debts (i.e., business debts), you do not need to satisfy the means test.
